A 99 year old North Devon woman has won her residential home compensation claim, recovering compensation following an accident at a residential home in Ilfracombe, North Devon.

The accident occurred as our client was walking past a door that led to the kitchen which was suddenly opened by a member of staff. The doors struck the woman and knocked her to the floor.
The accident resulted in our elderly client suffering a fractured hip.
Liability for the accident was admitted by the residential home’s insurers on the basis that there was no window in the door and therefore members of staff could not see if residents were passing by.
Our client had to undergo a partial hip replacement, following which she was moved to another nursing home in Devon.
Because of her age and medical condition, it was agreed with the insurers that a medical report could be obtained based solely upon a review of her medical records. This meant the ordeal of a personal examination was not necessary.
Instructions were provided by her daughters who had Power of Attorney, enabling them to deal with their mother’s affairs.
The client won her residential home compensation claim and was awarded injury compensation of £24,000 plus her legal costs.
