We are helpling a number of people in Devon and Cornwall with legal claims for compensation for unauthorised access to medical records following the scandal involving trainee surgeon Salil Korambayil.
Korambayil, who had previously been jailed for 14 years for raping two women, has now been convicted of offences relating to unauthorised access to patient records while working for the NHS in the south west.
He pleaded guilty to one count of securing unauthorised access to computerised material and one of unlawfully obtaining personal data. The data breaches involved telephone numbers, email addresses, and the addresses of a number of patients. This included women Korambayil had been flirting and engaging with on social media. He went on to rape one of the women whose data he had accessed without authorisation or permission.
Hospitals in Devon and Cornwall, including the North Devon District Hospital, are writing to the patients concerned to advise them of what has occurred. They are being urged to contact the NHS or the police if they have experienced any inappropriate conduct.
Compensation for unauthorised access to medical records can be claimed, and our team can help with recovering any direct financial losses victims have incurred, as well as compensation for the distress caused to them.
In the Korambayil case the emotional impact on those patients whose records have been accessed is likely to be particularly acute. Individuals who have been affected by data breaches of this kind often report a range of symptoms that include difficulty sleeping, eating issues, anxiety, panic attacks, and nightmares.
