Compensation for injury claims is set to increase

Accident claim solicitor, James McNally, from our Taunton office reports on the announcement that the amount of compensation accident victims will be entitled to receive for their injuries is to be increased.

The Court of Appeal has announced that personal injury compensation is to be increased by 10%. The increase will apply to judgements in all accident claims irrespective of the actual date the injury was sustained.

This increase will only apply to the ‘pain, suffering and loss of amenity’ element of the accident claim. This type of compensation is known by accident lawyers as general damages. Out of pocket losses and expenses incurred as a result of the injury (known as special damages) will stay the same.

The 10% increase in injury compensation has been brought in as part of a wider package of changes to the way personal injury claims are dealt with under the Government’s controversial Legal Aid, Sentencing and Punishment of Offenders Act 2012.
